As la.lv writes, citing explanations from lawyer Jānis Dzanushkans in a material from Latvian TV24, the season of national holidays raises the eternal question again: how to properly handle state symbols so as not to accidentally break the law?

These days, Latvia is drowning in red and white: flags on houses, small badges on clothing, ribbons on bags, mini-flags on cars. People are decorating both themselves and the city - and it is precisely at such moments that the question arises: where is the line between respect and violation?

The lawyer reminds us: the national flag, coat of arms, and anthem in Latvia are under special legal protection. Intentional public insult to the flag or coat of arms can result in up to three years in prison, forced labor, or a fine under the Criminal Law.

There are also administrative penalties - for example, for someone displaying a faded, dirty, or severely wrinkled flag.

But the most important thing is to understand what exactly is considered disrespect.

According to the lawyer, law enforcement looks at three factors:

  1. Was there intent - did the person want to insult the symbol?
  2. Did it happen publicly - that is, in view of society?
  3. Was the symbol used inappropriately - as provocation, advertisement, costume, parody?

The most famous cases

la.lv recalled a loud story from a decade ago when a man set fire to a flag and posted a video with insults - he received a suspended sentence.

It can also be different. Thus, the use of a swimsuit in the colors of the Latvian flag was deemed unethical but not a crime, as there was no intent to offend anyone.

The same applies to badges, ribbons, or small flags attached to clothing or cars. Throwing away a soiled or torn badge in the trash is not a crime - as long as the person does not make a public demonstration of disrespect out of it.

The main criteria are intent and publicity.

What if the flag is insulted abroad?

The lawyer explains: if a foreigner does this - Latvia cannot make any claims, as the action takes place under the jurisdiction of another country.

But if the same is done by a citizen of Latvia, even abroad, they can be held accountable because the insult is directed against the state.
