Residents of Latvia Forbidden to Publish Photos of Officials Without Permission: Both Honest and Dishonest

The Data State Inspectorate (DVI) agrees with the Ombudsman’s Office that visitors to institutions have the right to film and photograph officials for personal use; however, "rules of courtesy require" notifying the official of such intent in advance, and the obtained materials cannot be published on the internet, DVI reported.

The Data State Inspectorate (DVI) in collaboration with the Ombudsman’s Office has developed guidelines titled "On the Processing of Data of Officials in Audiovisual Form and the Publication of Such Materials." The guidelines state that filming an official for personal use is permissible; however, it is recommended to inform the official of such intent in advance, and such materials are not intended for publication on the internet.

In cases where the purpose of the filming is to inform the public or document a possible offense, such data processing must have a "legal basis." Furthermore, the official must be informed about the filming and its purpose, unless this objectively hinders the achievement of the intended goal.

The guidelines emphasize that officials, like any other individuals, have the right to privacy and protection of personal data.

It was previously reported that the Ombudsman’s Office clarified that publishing such materials on the internet may result in administrative penalties or even criminal liability.

The recommendations apply not only to state and municipal officials but also to employees of other institutions who interact with clients in their daily work and may find themselves in situations where their actions are recorded on video.
