Lawyer Predicts Possible Victory for Larisa Dolina in Moscow City Court

The defense will insist on the singer's vulnerable state.

The Moscow City Court may rule in favor of singer Larisa Dolina in the case regarding her eviction from an apartment, the owner of which has been recognized as Polina Lurie. This was stated by lawyer Nina Yeremenko.

"If the case were heading towards a formal confirmation of previous conclusions, there would be no need for this," Yeremenko noted, commenting on the appointment of a repeated psychological and psychiatric examination.

According to the lawyer, the repeated examination confirmed that at the time of the transaction, Dolina was in a state of stress, fear, and delusion — the same conclusions as before. However, the fact of a new study indicates that the court intends to seriously reconsider the circumstances of the case, rather than simply formally affirm the past decision.

Yeremenko emphasized that Dolina's side will insist on the singer's vulnerable state during the transaction and on the lack of due diligence on the part of the buyer. She also noted that in such transactions, it is necessary to obtain a certificate from a psycho-neurological dispensary, even if it involves a public figure.

The lawyer did not provide percentage estimates of the chances but called them "not low." She pointed out that public optimism after the case was returned for consideration might be premature — the process is still far from completion, and the legal picture may change.

"Right now, it feels like everything has already been decided. But that’s not the case. This case is still alive, and it really deserves close attention," Yeremenko summarized.

On December 16, the Supreme Court of the Russian Federation recognized the ownership rights of the disputed apartment belonging to Dolina in favor of the buyer Polina Lurie. It was specified that the instance also ruled to cancel all decisions of lower courts regarding the sale of the artist's apartment.

Later, on December 19, Dolina, after receiving an eviction notice from her new landlord Lurie, reported fraud to the police. Lurie’s lawyer, Svetlana Sviridenko, in turn, stated that the singer continues to reside in the Moscow apartment, which the Supreme Court of Russia recognized as the property of the buyer.

On December 21, the Supreme Court of the Russian Federation, in the text regarding the complaint of the buyer Lurie, stated that Dolina's delusion at the time of the apartment sale is not a sufficient basis for canceling this transaction. The court noted that only significant delusions of a party are recognized as defects in the transaction, in the absence of which a person, reasonably and objectively assessing the situation, would not have made the transaction at all.
