The Administrative District Court rejected the prosecutor's request to annul the building permit for the crematorium in the Salgale parish of the Jelgava region.
The court concluded that the construction project complies with the existing territorial planning, which permits the placement of such facilities in this area.
The court did not establish that there was an obligation to conduct a public discussion prior to the issuance of the building permit in this case.
Upon reviewing the case materials, the court also did not identify any circumstances indicating a significant impact on the environment.
At the same time, the court noted that although the public discussion was organized after the issuance of the building permit, the public was given the opportunity to express its opinion, and the identified procedural deficiency is not significant.
The court emphasized that the subjective attitude of the public towards a certain type of facility is not in itself a legal basis for prohibiting construction if it complies with the requirements of regulatory acts.
Considering the above, the court recognized that no violations of legal norms were established that would justify the cancellation of the building permit.
The decision may be appealed in the appellate order.
