Starting this year, amendments to the Law on the Enforcement of Confiscation of Property Obtained Through Criminal Means come into effect in Latvia, establishing a procedure for cases where property is mixed with legally obtained funds.

Until now, the law did not provide a procedure for enforcing decisions on the confiscation of property only in the part that was obtained through criminal means. Therefore, a solution was needed for cases where criminally obtained funds are mixed with legally obtained ones, for example, in the case of real estate.

When enforcing a decision on the confiscation of property obtained through criminal means, the task of the bailiff is to alienate the confiscated property and direct the proceeds to compensate for the damage caused to the victims, while the remaining amount will be transferred to the state budget.

In turn, in cases where legal and illegal property is mixed, from the funds obtained from the alienation of the property, the amount corresponding to the criminally obtained funds will be transferred to the state budget, while the remaining part will be recognized as legally obtained funds.
