The Bureau for Prevention and Combating Corruption (BPBCK / KNAB) has proposed to initiate criminal prosecution against two individuals who allegedly prepared to give a bribe of 100,000 euros to a state official of the Ministry of the Interior to lift the entry ban for a foreigner included in the list of undesirable persons for Latvia, reports LETA.
According to BPBCK, two citizens of Latvia and two citizens of Russia acted as part of an organized group and planned to give a bribe to an official of the Ministry of the Interior.
The purpose of the bribe was to lift the entry ban to Latvia for one of the Russian citizens involved in this crime and included in the list of undesirable persons.
Since two of the suspects are outside Latvia, BPBCK has initiated a separate criminal proceeding against the two Russian citizens. A decision on further actions in this case will be made together with the supervising prosecutor.
Additionally, BPBCK notes that the Ministry of the Interior closely cooperated during the investigation, and the alleged bribe to the official was not delivered for reasons beyond the control of the alleged bribe-givers.
The criminal process was initiated on August 5 on the grounds of a crime for which responsibility is provided for in part two of Article 15 and part three of Article 323 of the Criminal Law — preparation for the transfer of a bribe to a state official committed by an organized group.
On November 3, BPBCK transferred the materials of the criminal case to the prosecutor's office for the investigation of crimes in public service, completing the corresponding investigation. Now the prosecutor's office, as the leading prosecuting party, must decide on the further advancement of the criminal process.
BPBCK emphasizes that individuals involved in the criminal process have the right to defense and reminds that the presumption of innocence applies at all stages of the criminal process — from the moment a person becomes a suspect or accused until their guilt in committing the crime is established in accordance with the law.
