The Latgale District Court approved the decision that the woman must pay compensation of 10,000 euros for the death of a man who died as a result of a traffic accident, the LETA agency found out.
According to the materials of the criminal case, the accused woman did not reduce her speed in time before the unregulated pedestrian crossing and hit a pedestrian who had stepped onto the crossing. Later, the victim died in the hospital from the injuries sustained. The first-instance court found the accused guilty and sentenced her to conditional imprisonment for one year and seven months, as well as established a probation period of two years.
In favor of the son of the struck pedestrian, recognized as the victim in the case, compensation for damages was awarded from the accused, which included expenses for legal assistance and compensation for moral harm.
The appellate court overturned part of the sentence regarding compensation for moral harm. According to the court's assessment, such compensation was not subject to recovery in the criminal process, as the insurance company had already compensated the victim.
The mother of the victim filed a cassation complaint against the decision of the appellate court, and the Supreme Court of Latvia annulled part of the district court's decision, according to which the victim was not awarded compensation for moral harm.
The Supreme Court established that the cassation complaint rightly pointed out that the appellate court did not assess whether the victim was the breadwinner of the deceased father or was dependent on him.
The case was sent for reconsideration. As a result, the Latgale District Court approved the decision to pay compensation in the amount of 10,000 euros.
However, this decision can also be appealed in cassation within ten working days from the date of its full availability — from May 25.
