ECtHR condemned the Latvian state: a woman imprisoned was denied medical assistance

The European Court of Human Rights (ECtHR) issued a ruling in the case of "M.A. v. Latvia," finding a violation of the European Convention on Human Rights, the Latvian Ministry of Foreign Affairs reported.

The woman complained to the ECtHR that from July 13, 2021, to February 4, 2022, she continued to serve her sentence of imprisonment, including in a prison hospital, although the court had ordered her to be placed in a psychiatric hospital. She claimed that during this time she was not provided with adequate treatment.

The court established that the court had ordered the applicant to be sent to a psychiatric hospital. The ECtHR recognized that after July 13, 2021, when the decision to place her in a psychiatric hospital was made, further imprisonment became incompatible with the purpose of the original sentence.

The ECtHR concluded that the Latvian state institutions failed to provide proper coordination of actions, which led to an almost six-month delay in her placement in a psychiatric hospital.

The court acknowledged that such a delay was not in accordance with the provision of the Convention governing the deprivation of liberty of persons with mental disorders and found a violation. The woman was awarded compensation of 9,000 euros.

Within three months of the announcement of the decision, the parties may request the case to be referred to the Grand Chamber of the ECtHR.
