Once in hand, never returned? Can a gift be returned if a gift agreement is made

As the end of the year approaches, residents begin to consider their options for big and small gifts under the Christmas tree. Can large gifts be returned if the donor has changed their mind?

There are various situations – a gift agreement is made, but everything changes and the donor has had a change of heart. Can such an agreement be terminated?

A concluded gift agreement can be canceled by mutual consent of the parties and by signing a contract for the cancellation of the gift agreement, confirms Latvian sworn notary Agita Macievska.

A gift agreement can be canceled by filing a lawsuit in court if the basis for this is gross ingratitude of the donee and the agreement cannot be terminated by mutual consent (applies to adults).

Gross ingratitude of the donee is considered to be gross insults to the donor in words or actions, intentionally causing significant material damage to him, threats to his life, as well as leaving him in a helpless state when it was possible to help him (Article 1919 of the Civil Code of the Republic of Latvia).
