The Ministry of Justice and Digital Technologies is preparing amendments that tighten penalties for environmental offenses and significantly increase maximum fines for enterprises.

According to the bill, the maximum fine for creating a fire hazard in nature will increase from 3,200 to 200,000 euros. The maximum penalty for offenses causing damage to vegetation will also increase to the same amount, that is, to 200,000 euros.

The most significant change will concern violations of the requirements for the transportation, storage, or processing of natural resources — in this case, the maximum fine will increase from 3,200 to 400,000 euros. For violations of the requirements for accounting for natural resource use or pollution, the maximum fine will rise from 2,000 to 100,000 euros.

The changes will primarily affect enterprises and other legal entities. According to the explanatory note to the bill, the current fine amounts are no longer sufficiently effective, as they have not been changed for almost 15 years, during which time the turnover and profits of companies have significantly increased.

In addition to tightening monetary fines, it is also proposed to give the court the ability to impose a ban on activities for up to three years and a ban on entrepreneurial activities for a period of one to five years for environmental offenses.

The aim of the amendments is to make violations that harm the environment significantly more risky for enterprises and to reduce the number of situations where non-compliance with requirements may turn out to be more economically advantageous than compliance.
