The Consumer Rights Protection Center (PTAC) recorded violations of the Law on the Circulation of Alcoholic Beverages in shopping centers.
The institution established that decorations were placed in shopping centers — stands in the shape of Christmas trees with empty bottles of the alcoholic beverage "Jameson." At the same time, PTAC noticed that retail chains were simultaneously offering discounts on alcoholic beverages of this brand, which encourages consumers to purchase alcohol and is illegal.
PTAC notes that in this case, the Christmas decorations — tree stands made of empty bottles of the alcoholic beverage "Jameson," including in the context of the promotions offered for the alcoholic beverage "Jameson," are aimed at promoting a specific product and indicate a violation of the prohibition established by the Law on the Circulation of Alcoholic Beverages.
PTAC urges shopping centers and retail chains to immediately eliminate the violations, and in the future, not to place decorations of this kind in their premises.
PTAC notes that according to the Law on the Circulation of Alcoholic Beverages, advertising prices and discounts on alcoholic beverages is prohibited, including in retail locations where alcoholic beverages are sold, including remote contracts on websites and mobile applications. The Law on the Circulation of Alcoholic Beverages also provides for a ban on conducting promotional events for alcoholic beverages in retail locations, including through remote contracts on websites and mobile applications.
The ban means that direct and indirect references to the profitability of a specific alcoholic beverage are not allowed, and events that stimulate the sale and consumption of alcoholic beverages are also not allowed, including in retail locations, the purpose of which is to stimulate the purchase of products, including in large quantities, to encourage the trial of new products, and to prompt spontaneous purchases.
For non-compliance with advertising requirements, PTAC has the right to impose a fine of up to 14,000 euros, and for non-compliance with the ban on promotional sales events established by the Law on the Circulation of Alcoholic Beverages, PTAC has the right to impose a fine of up to 30,000 euros.
