Starting from March 1, 2026, a custody agreement regarding the right to custody of the child, the procedure for communication with the child, and alimony must be formalized by a notary as a notarized deed during divorce.
This is not just a formality: if one parent stops fulfilling the agreements, the other can initiate the enforcement process immediately, bypassing the court.
"Parents could previously agree 'on paper' without the involvement of a professional, but this often led to legal errors. Now, the notary acts as a neutral party, ensuring that the child's interests are upheld and that the agreement itself is legally sound and enforceable," said Aigars Kaupe, Chairman of the Council of Notary Publics of Latvia.
Naturally, the agreement will not be issued for free.
