The family of basketball player Janis Timma continues to fight for his son Christian to receive the inheritance left by the athlete. According to the marriage contract, singer Anna Sedokova received all of the athlete's property, reports tv3.
The interests of the family are represented by lawyer Margarita Gavrilova, who does not receive a cent for her work, acting solely on principle. She shares the latest news on social media.
Margarita explains that Anna and Janis lived in two countries — Russia and the USA. The marriage contract was concluded in America, and based on it, after the athlete's death, all property passed to Anna, who has already sold it without passing on any shares of the inheritance to Timma's son.
After a lengthy investigation, it became clear that the document referred to as a marriage contract has no legal force. The lawyer who signed this document did not have the legal authority to do so. Janis's family lawyer is convinced that Sedokova was aware of this, and therefore her actions can be regarded as fraud.
"According to information provided by public notary Alena Green from the state of Florida, the marriage contract does not exist. She did not draft it, did not notarize it, and did not participate in its preparation, which she informed Anna Sedokova about. The notary explained that this document is not a marriage contract but merely notarizes the signatures of the parties. Moreover, the document itself is illegal, as Ms. Green is a public notary and not a state notary, and does not have the right to notarize such documents," explains Janis's family lawyer.
"This is a forgery, an invalid document. Nevertheless, she used it when selling joint property. We obtained this document from the Rosreestr, where Sedokova herself submitted it as justification for the absence of her husband's written consent — allegedly due to the existence of a marriage contract," he added.
Human rights defenders plan to initiate a criminal case against Sedokova under Article 159 of the Criminal Code of the Russian Federation, which concerns fraud. In turn, the team of lawyers intends to challenge all transactions made based on the marriage contract and demand half the value of all assets sold by Sedokova.
"It is important to understand that Janis lived with the belief that there was a legitimate marriage contract, and Anna convinced him of this. According to this contract, he was allegedly obliged to give her everything he acquired," explains the lawyer.
Margarita believes that Anna took advantage of trust, emotions, and, in the spirit of the 90s, deceived the victim. The lawyer calls it a criminal scheme — playing on a person's feelings with the intent to mislead.
